Applications are invited to fill up 5 (five) posts of Civil Judge, Junior Division and Judicial Magistrate First Class on adhoc and temporary basis for a period of 5 years from the date of sanctioning the posts by the Government of Goa, as per the Goa Judicial Service Rules, 2013 (vide Order No.13/5/2013-LD(Estt)/1778 dated 25/08/2015 of the Department of Law & Judiciary, Law (Establishment) Division, Government of Goa) in the Goa Judicial Service in the pay scale of Rs.27700-770-33090-920-40450-1080- 44770 and other allowances as admissible under the Rules.

Name of the Post : Civil Judge

Eligibility Criteria :

I. Educational Qualifications :

Essential :
  1. Degree in Law.
  2. Knowledge of Konkani.
Desirable :

Knowledge of Marathi.

Candidate must have sufficient knowledge of Konkani. Knowledge of Marathi is desirable. Such knowledge must be certified :

(a) in case of an Advocate, by the Principal District Judge of the District or the Principal Judge of the Court where he practices.

(b) In case of a fresh law graduate, by Principal or Head of the College or University Department where the candidate was enrolled for L.L.B or L.L.M. Degree.

(c) In case of members of staff, by the Head of the Office under whom such candidate is working.

II. Experience :

Must have practiced as an Advocate in the High Court or Courts subordinate thereto for a period of three years. OR

Must be a fresh Law Graduate who has secured the degree in law by passing all the examinations leading to the degree in the first attempt and has secured in the final year examination of the degree in Law or in case of candidates holding Master's Degree in Law at final L.L.M. examination not less than fifty-five percent marks. OR

Must be working or must have worked as a Public Prosecutor or Additional Public Prosecutor or Assistant Public Prosecutor or Government Advocate for not less than 3 years in the post or posts. In computing the period of 3 years, the period during which the candidate has worked as an Advocate shall be included. OR

Must be a member of Ministerial staff of -

(i) the High Court or Courts subordinate thereto; or

(ii) the offices of the Government Pleaders attached to those Courts; OR

Must be working as Superintendent in the High Court of Bombay at Goa, Panaji or in the Courts subordinate thereto in Goa and holding a Degree in Law or Sub-Registrar or District Registrar in Goa and holding a Degree in Law or Legal Assistant in the Law Department of the Government of Goa or Superintendent (Legal/Drafting) in the Law Department of the Government of Goa, for not less than 5 years in the post or posts.

III. Age : As on the date of Advertisement.

Not less than twenty one years and not more than -
  • (i) thirty-five years in the case of Advocates with three years practice,
  • (ii) twenty five years in case of fresh Law Graduates.
  • (iii) forty-five years in the case of ministerial staff.
Provided that the upper age limit in each of the above categories may be relaxed by five years in respect of candidates belonging to communities recognized as backward by the Government for the purpose of recruitment. 

INSTRUCTIONS TO THE CANDIDATES

1) A candidate appointed will be initially on probation for a period of two years.

2) A candidate must submit with his/her Application, attested copies (not the originals) of Certificate showing :
  • (i) his/her age as on the date of Advertisement.
  • (ii) his/her standing as Practitioner in Court or serving as a Public Prosecutor or Additional Public Prosecutor or Assistant Public Prosecutor or Government Advocate for not less than three years in the post or posts.
  • (iii) he/she is a member of ministerial staff of the High Court or Courts subordinate thereto or the Offices of the Government Pleaders attached to those Courts. 
  • (iv) he/she is working as Superintendent in the High Court of Bombay at Goa, Panaji or in the Courts subordinate thereto in Goa and holding a Degree in Law or Sub-Registrar or District Registrar in Goa and holding a Degree in Law or Legal Assistant in the Law Department of the Government of Goa or Superintendent (Legal/ Drafting) in the Law Department of the Government of Goa, for not less than five years in the post or posts.
  • (v) that he/she is of good moral character from two respectable persons.
  • (vi) that he/she has sufficient knowledge of Konkani and Marathi languages and that, he / she is able to speak, read & write Konkani and Marathi and is able to translate with clarity and ease Konkani & Marathi into English and vice versa. 
  • (vii) any other certificates as may be deemed fit, and
  • (viii) a candidate belonging to a Backward Class must also produce the certificate to the effect that he/she belongs to a community recognised as Backward for the purpose of recruitment to the service under the Government of Goa.

3) (a) Certificates under 2 (ii) and (vi) may be signed by the Registrar of the High Court of Bombay at Goa, Panaji-Goa or in the case of other Courts than High Court by the Principal District Judges or the Principal Judge of the Court, as the case may be, in which the applicant has practiced and should state the period during which the candidate has actually practiced.

(b) The certificate mentioned in 2 (iii) and (iv) may be signed by the head of the office under whom such candidate is working.

(c) The certificate mentioned in 2 (v) testifying to his/her character may be signed by respectable persons unconnected with the intended candidates' College or University and not related to him/ her.

Original Certificates and Testimonials should be submitted only when required and if forwarded with the application will not be returned. Application containing incorrect/incomplete information in any respect shall be rejected.

4) The examination will be held in following three stages -

(i) Preliminary written Examination comprising of multiple choice objective questions, carrying total 100 marks.

The medium of preliminary examination shall be English.

The aim of Preliminary written Examination is to shortlist the candidates to appear for final written examination. Therefore, in all 10 times candidates of total number of posts will be allowed to the final written examination as per the merit list of the preliminary written examination. The preliminary examination being screening test, its marks will not be taken into consideration for final selection and will not be communicated to the candidates. 

(ii) The candidates found eligible in the preliminary written examination will have to appear for final written examination which shall be of two papers carrying 100 marks each, having duration of 3 hours each in Civil Laws and Criminal Laws respectively. The medium of the written examination shall be either Konkani or Marathi or English. The candidate shall specifically mention in his/her application form about his choice of medium. Choice once given shall not be allowed to be changed subsequently in any case.

(iii) The High Court shall hold viva-voce examination carrying 50 marks of the candidates who secures not less than 50% of marks in each paper at such final written examination. 

Provided that the Scheduled Castes and Scheduled Tribes candidates who secure not less than 45% marks in each paper shall be eligible for the viva-voce.

Provided that only such candidates who have obtained at least 40% of marks in viva-voce test shall be eligible for selection.

6) The candidates will have to appear for preliminary, final written examination and for interview if called for at his own expenses.

7) A candidate who is found indulging in unfair practices viz, copying or mis-conduct during the course of written examination, or has been convicted in criminal case or is compulsorily retired, removed or dismissed from judicial service or could not successfully complete probation period of any post in judicial service shall not eligible to appear for competitive examination. 

8) Disqualification for appointment : A person shall not be eligible for appointment to the service ,-
  • (a) if he/she is not a citizen of India; or
  • (b) if he/she is compulsorily retired, removed or dismissed from judicial service or from service in Government or Statutory or Local Authority or failed to complete probation period in judicial service on any post, or in Government or Statutory or Local Authority; or
  • (c) if he/she has been convicted of an offence involving moral turpitude or he/she is or has been permanently debarred or disqualified by the High Court or the Union Public Service Commission or any State Public Service Commission from appearing for examinations or selections conducted by it; or
  • (d) if he/she directly or indirectly influences the Recruiting Authority by any means for his/her candidature; or
  • (e) if he is a man, who has more than one wife living and if a woman, has married a man already having another wife; or 
  • (f) if he/she has more than two children.
Explanati  :- For the purpose of this clause, where a couple has only one child, any number of children born out of a single subsequent delivery shall be deemed to be one child.

Provided that, a person having more than two children on the date of commencement of the Goa Judicial Service Rules, 2005 i.e. 30.06.2005, shall not be disqualified for appointment under this clause so long as the number of children he had on the date of such commencement does not increase.

Provided further that a child or more than one child born in a single delivery within the period of one year from the date of such a commencement shall not be taken into consideration for the purpose of disqualification mentioned in this clause.

A candidate shall submit, along with the application form, declarations appended to the present advertisement.

9) No person selected for appointment shall be appointed -
  • (i) unless the Appointing Authority is satisfied that he/she is of good character and is in all respects suitable for appointment to the service;
  • (ii) unless it is certified by the medical authority specified by the High Court that he/she is medically fit to discharge the duties of the post to which he is selected for appointment.

10) Application should be submitted only by Registered Post or Speed Post with acknowledgment in the prescribed format along with copies of testimonials referred to above and two passport size colour photographs, one duly affixed on application and one in separate envelope without pinning it to any paper, so as to reach the Office of the Registrar (Administration), High Court of Bombay at Goa, Lyceum Complex, Altinho, Panaji-Goa 403 001, on or before 18th January, 2016. The Application should be accompanied  by fees in the sum of Rs.500/- for Scheduled Castes/Scheduled Tribes candidates and Rs.1000/- for other category candidates, in the form of demand draft in favour of the Registrar, High Court of Bombay at Goa, Panaji, payable at par at Panaji-Goa. Fees shall not be refunded in any case. The envelope should be inscribed as “APPLICATION FOR THE POST OF CIVIL JUDGE, JUNIOR DIVISION & JUDICIAL MAGISTRATE FIRST CLASS IN THE GOA JUDICIAL SERVICE”. The candidates are required to download the format of the application from the official website of the High Court of Bombay at Goa, i.e. http://www.hcbombayatgoa.nic.in. Applications received after prescribed date will not be accepted on any ground. 

11) High Court reserves its right of shortlisting at the time of scrutiny of applications by applying uniform and reasonable norms.
